Your Real Estate Lawyers
Efficiency, entrepreneurial thinking and our clients success are our top priorities.
Whether you are a general contractor constructing a simple residential building or a complex industrial plant on a turnkey basis for the client - regularly for a lump sum price - we provide you with legal advice on questions of liability for defects, the consequences of delays in construction, rights to issue orders, contractual penalties and changes in performance in complex construction projects and support you in examining and successfully negotiating appropriate contractual provisions. We also advise you in the event of insolvency of subcontractors and the consequences for the construction project, as well as on questions regarding the protection of your remuneration claims.
Since in the context of such a general contractor agreement - structured as a construction contract or consumer construction contract - you usually do not provide the contractually owed services (construction services, but typically also planning services) entirely yourself, but by using subcontractors (in practice also called subcontractors), you have contractual obligations both towards the client and towards the subcontractors. We provide you with legal support by drafting, reviewing and negotiating the general contractor agreement and its annexes so that your legal interests are protected in the best possible way in both directions.
We therefore also support you in drafting, negotiating and concluding the individual subcontractor agreements. In doing so, we pay particular attention to ensuring that you achieve congruence between the subcontractor agreement and the general contractor agreement with regard to deadlines, construction cost specifications, changes in services, fees and other parameters of the construction project. In this way, we avoid "gaps" for you in the provision of services and remuneration.
