A compulsory auction serves to enforce a claim against the immovable property of an owner with the aim of obtaining the highest possible realisation proceeds through public auctions. Immovable property includes ownership of real property, rights to real property (hereditary building rights to a plot of land) and non-material co-ownership shares. The essential elements (sections 93, 94 BGB), rights associated with ownership (section 96 BGB), easements (section 1018 BGB) and subjective real rights (sections 1103 (1) and 1110 BGB) and accessories (section 97 BGB) are also auctioned.
