The BGH decided that it is no longer permissible to settle a claim for damages due to defects in the building on the basis of the (fictitious) costs of remedying defects that are expected to be necessary but have not yet been incurred.

The Federal Supreme Court and the Higher Regional Court of Koblenz have both stated that architects must be very careful not to give unauthorised legal advice when providing services to their clients.

German Federal Court (BGH): Deviation from the quality agreed in the contract for work even if the work does not have the agreed functional capability

In its ruling of November 8, 2007 (Case No. VII ZR 183/05), the German Federal Court clarified that a work does not comply with the agreed quality even if it does not have the agreed functional capability.

BGH: Im Werkvertragsrecht keine fiktive Schadensberechnung mehr

In einem bahnbrechenden Urteil hat der VII. Zivilsenat des BGH am 22.02.2018 (Az. VII ZR 46/17) seine bisherige Rechtsprechung zur Möglichkeit der fiktiven Schadensberechnung von Mängelbeseitigungskosten im Werkvertragsrecht aufgegeben.
